| Challenge Rules
A PURCHASE IS NECESSARY TO ENTER.
THIS PROMOTION IS INTENDED FOR PARTICIPATION IN THE UNITED STATES ONLY,
AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO US LAW.
How to Enter/Register
To enter the contest, participants must open a trading account online at the contest web site at www.ArtificialStocks.com. From that page participants will click on the “Open Trading Account” link to access the registration screen. In order to register participants must accurately complete all the fields on the registration page, including their email address. Registration is $50 per month. Limit one registration per person and per e-mail address. No mechanical reproductions or automated or duplicate registrations are permitted. Sponsor is not responsible for late, lost, misdirected, or ineligible registrations that are not timely received or are lost due to computer or electronic malfunction or other error. All registrations become property of Sponsor and will not be returned. Contest is unlimited to the number of participants who register.
Eligibility
Open to legal residents of the 50 United States, and Washington DC, who are 18 years of age or older at the time of entry. Employees of Sponsor, STOCK-TRAK and their subsidiaries, advertising and promotion agencies and prize suppliers are not eligible. This contest is subject to all
applicable federal, state and local laws. The laws of the United States
govern this promotion.
Void where prohibited by law.
Registration Period/Trading Dates/Initial Cash Balance
The trading period (the period during which a participant may make
trades in his or her account) begins at 9:30 AM ET on Monday's and ends
at 4:00 p.m., ET on Friday's of each contest week. The initial "cash balance" in each participant's account is $100,000 in fictitious funds.
How to Trade
In order to trade, each participant will be required to establish a fully complete registration. After receiving a unique Account Number and Password, each registrant will then be eligible to receive exclusive, step-by-step trading strategies from TradeRatios.com. Only trading strategies from TradeRatios.com are eligible for use in this contest. Each trading strategy provides detailed information about what-when-and-how-to-trade selected stocks. The participants need to determine the number of shares to enter as a result of their assessments of broad market conditions. Participants will visit the Web Site to make trades, review account activity, research stocks, obtain quotes and charts, and find ticker symbols.
There are four basic ways to trade stocks: buy, sell, short sell, and short cover. To trade on the web site, participants click on "Make a Trade" on the navigation menu and access the stock order screen. Participants then complete the necessary information for the trade they
wish to make and then submit their order. Participants may also trade
artificial stocks via telephone by calling the customer service line.
Trading Times
Trades made via the Web Site will receive delayed prices (15-20 minutes) as long as the trade is placed between the times of 9:30 a.m. ET and
4:00 p.m. ET. Trades placed after 4:00 p.m. ET will receive the next day's open price. Sponsor is not responsible for trades that are not
received or are incomplete for any reason, including technical problems
or server maintenance.
Splits and Dividends
All stock splits and all dividend payments over $0.10 will be credited to your portfolio. Splits that have been credited to your portfolio have
the appearance of a buy or short sell, but the price per share is $0.00.
Dividends will appear in your portfolio with the "ticker symbol-DIV" to alert you to a dividend payment.
Volume and Purchase Restrictions
- The minimum transaction (aggregate purchase or sale price, before commission) by any participant in any individual stock or ETF is $5,000; the maximum transaction by any participant in any individual stock or ETF is $20,000. Participants may not buy or short sell stocks trading under $5.00 per share.
- During the course of the weekly contest, participants may make up to an aggregate of 10 trades. Participants do not have to be "fully invested".
- Trades can be made as "market" or limit orders. Stop and loss orders are permitted.
- The maximum number of shares a participant may trade is limited to the actual volume on the stock that day.
- Participants may not hold a short and long position in the same stock at the same time.
- Occasionally prices may vary from one quote source to another.
- Adjustments will not be made because of price discrepancies on any given day unless the price was outside the range quoted in The Wall Street Journal for that day.
Trading Fees
A trading fee (similar to a brokerage commission) is applied to all transactions and will be deducted from a participant's fictitious funds balance. The trading fee for all trades made is $25 on each trade regardless of the number or value of shares.
Margin Requirements
The margin requirement for stock purchases and short sales is 50%. This means that for stock purchases you can borrow up to 50% of the total
cost. For short sales, you must deposit an amount equal to 50% of the current market value of you short positions. Starting with $100,000
Sponsor may "loan" you another $100,000 of fictitious funds, making your
total buying power $200,000 if you are trading in marginable securities.
For this challenge, all stocks are marginable.
Interest Earned
Interest will be earned on all available cash balances and credited at the close of each day. Interest will be calculated using a rate of 3% per annum.
Interest Charged
Interest will be charged on all loan balances and will be debited at the close of each day. The rate of 8% per annum will be charged on all loan (margin) balances.
Portfolio Evaluation
Participants can review their activity and ranking at any time during the contest. Please review your account activity and report any discrepancies immediately. Transactions that are disputed after the posting date will not be adjusted.
Calculation of Portfolio Value
A portfolio's equity or value is calculated as follows:
Cash - Debit balance + Credit balance + MV of long positions - MV of
short positions where Debit = loan balance, Credit = short sales
proceeds, and MV = current market value.
MV will be determined using STOCK-TRAK's quote provider or such other quote provider as determined by Sponsor in its sole discretion.
End of Contest
You do not need to convert all of your investments to cash on the last trading date of each contest. Your portfolio will be valued based on the
weekly and monthly contests at the closing prices for that date. The
official winner of each contest will be announced by Sponsor within 24 hours of the last trading date of each contest.
Disputes, Errors, and Other Information
When you make a trade, you will receive a confirmation. You must keep copies of your confirmations. If you believe an error has been made on your account, please call STOCK-TRAK at 1-800-786-TRAK during office hours. Please do not call without the confirmation number of the trade in question because nothing can be resolved if this information is not provided.
Representatives of Sponsor have the ultimate authority to settle disputes. All decisions made by Sponsor are final and binding.
These rules are subject to modifications without notice.
Acceptance of a prize constitutes permission for Sponsor to use winner's
name and likeness for advertising and promotional purposes without
additional compensation, unless prohibited by law. Participants further
grant Sponsor the right to use and publish their proper name and state
of residence online, in print and any other media in connection with
this contest. By entering, participants release and hold harmless
Sponsor, its parent, subsidiaries, affiliates, directors, officers,
employees and agents from any and all liability or any injuries, loss or
damage of any kind arising from or in connection with participation in
this contest or acceptance or use of the prize. By entering, you agree
to Sponsor's use of your personal information as described in Sponsor's
Privacy Policy, in
addition to any use specifically authorized or mentioned herein.
Limitation of Liability
By entering the contest, participant agrees that (A) any claims,
judgments and awards shall be limited to actual out-of-pocket costs
incurred, including costs associated with entering the contest, but in
no event attorneys' fees; and (B) under no circumstances will any
participant be permitted to obtain any award for, and participant hereby
waives all rights to claim, punitive, incidental or consequential
damages and any and all rights to have damages multiplied or otherwise
increased and any other damages, other than damages for actual out-of-pocket expenses. As a condition of participating in this Promotion,
participants agree that any and all disputes which cannot be resolved
between the parties, and causes of action arising out of or in
connection with this Promotion, shall be resolved individually, without
resort to any form of class action, exclusively before a court located
in New York County, New York having jurisdiction.
Construction
All issues and questions concerning the construction, validity,
interpretation and enforceability of these Official Rules, or the rights
and obligations of any participant and Sponsor, shall be governed by,
and construed in accordance with the laws of the state of New York,
without giving effect to any choice of law or conflict of law rules or
provisions (whether of New York, or any other jurisdiction) that would
cause the application of the laws of any jurisdiction other than New
York. The invalidity or unenforceability of any provision of these rules
shall not affect the invalidity or unenforceability of any other
provision. In the event that any such provision is determined to be
invalid or otherwise unenforceable, these rules shall be construed in
accordance with their terms as if the invalid or unenforceable provision
was not contained therein.
Individual Registration Only
Each registration must be submitted only by the participant, and only at the authorized Web Site address. Entries submitted by any other individual or any entity originating at any other Internet web site or e-mail address will be declared invalid and, as such, ruled ineligible for this promotion.
Tampering/Technical Problems
The contest shall be void and Sponsor shall have no responsibility or liability therefore if, for any reason, the contest is not capable of
running as planned, whether due to infection by computer virus, bugs,
tampering, unauthorized intervention, fraud, technical failures, or any
other causes beyond the control of Sponsor which corrupt or affect the
administration, security, fairness, integrity, or proper conduct of this
contest. Sponsor reserves the right at its sole discretion, to
disqualify any individual who tampers with the entry process or
otherwise corrupts or impinges on the administration, security,
fairness, integrity or proper conduct of this contest, and to cancel,
terminate, modify or suspend the contest. Sponsor assumes no
responsibility for any error, omission, interruption, deletion, defect,
delay in operation or transmission, communication line failure, theft or
destruction or unauthorized access to, or alteration of, registrations,
trades or other account activities. Sponsor is not responsible for any
problems or technical malfunction of any telephone, cable or DSL network
or lines, computer on-line systems, servers, or providers, computer
equipment, software, failure or any e-mail, registration, trade or other
account activity to be received by Sponsor on account of technical
problems, human error or traffic congestion on the Internet or at any
web site or any combination thereof, including any injury or damage to
entrant's or any other person's computer related to or resulting from
participation or downloading any materials in this contest.

CAUTION: ANY ATTEMPT BY A PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR
UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
In the event of a dispute, registrations will be deemed made by the
authorized account holder of the e-mail address submitted at time of
entry. "Authorized account holder" is defined as the natural person who
is assigned to an e-mail address by an Internet access provider, on-line
service provider or other organization (e.g., business, educational
institution, etc.) that is responsible for assigning e-mail addresses
for the domain associated with the submitted e-mail address.
